WILLS (Will, Durable Power of Attorney,Advanced Healthcare Directive)
Will. No one likes to think about dying, but its important to make sure you family will be provided for if something should happen to you.
Having a will ensures:
Ø your assets are distributed according to your wishes
Ø you can designate guardianship of minor children
Ø undesired persons may be prevented from inheriting from your estate
Ø your personal matters and estate are handled according to your wishes
If you have questions regarding whether you need a will, you should contact the Law Office of Karen Y. Vicks, LLC. Attorney Vicks will schedule an appointment to meet with you to answer your questions and address your concerns.
Durable Power of Attorney. Have you given thought as to how your personal and other business matters would be taken care of in the event of your physical or mental incapacitation? If you were to execute a power of attorney while you are competent, you can appoint the person you desire to make business or financial decisions on your behalf in the event of your incapacitation.
Reasons to execute a Durable Power of Attorney:
Ø Allows you to appoint someone you trust to act on your behalf
Ø You can decide your wishes ahead and convey them to the appointee
Ø You eliminate the need for loved ones to file a petition for guardianship in the event you are incapacitated
Ø It is too late to draft a durable power of attorney once you are deemed physically or mentally incapacitated.
Ø The durable power of attorney ceases upon your death (A durable power of attorney does not replace the need for a will)
If you would like Attorney Vicks to draft your power of attorney, contact the Law Office of Karen Y. Vicks, LLC today for an appointment.
Advanced Healthcare Directive. If you are opposed to certain medical treatment or wish to appoint someone to make medical decisions on your behalf in the event of your incapacitation, then you should have an Advanced Healthcare Directive (also known as a “living will’). The Advanced Healthcare Directive can address issues including but not limited to:
Ø donating organs
Ø refusing life support
Ø consent or refusal of certain surgical procedures or administration of medications
Ø admittance to nursing homes/assisted living facilities
If you are concerned about your medical treatment in the event you become incapacitated it may be in your best interest to have an Advanced Healthcare Directive. Contact the Law Office of Karen Y. Vicks, LLC for an appointment. Attorney Vicks will be happy to discuss your needs and concerns.
